Merc Site Search Terms of Use
Effective 19 October 2026. Published at https://mercai.in/site-search/terms.
These Terms of Use ("Terms") are an agreement between Kamaldeep Singh, trading as MercAI ("we", "us"), and you, the owner or authorised manager of a website who installs Merc Site Search (the "Service"). By installing or using the Service you agree to these Terms and acknowledge our Privacy Policy at https://mercai.in/site-search/privacy. If you do not agree, do not install the Service.
1. The Service. Merc Site Search indexes the public content of your site (pages, products, blog posts, events, services and similar items) and provides a search box, a results widget and a dashboard. The dashboard shows what is indexed, when each item was last updated, and any item that could not be read. We may improve or change features over time; we will not remove a paid feature from a plan during a paid period without notice.
2. Account and site instance. The Service is tied to the site on which you install it, identified by its app instance. You are responsible for activity in your site's dashboard. You must have the authority to install apps on the site and the legal capacity to enter a binding contract under the Indian Contract Act, 1872, or the law of your home jurisdiction.
3. Plans and billing. The Service has a Free plan and paid plans described in the app listing. Paid plans are purchased, renewed, cancelled and refunded through the website platform's own billing system, under its terms. We do not take payment directly and do not use external payment links. Prices are shown in USD before you buy. When a paid plan ends, the site moves to the Free plan.
4. Plan limits. Plan limits apply to page counts, check frequency and extra features. The search engine and ranking are the same on every plan. Items above your plan's limit are not indexed, and the dashboard says so.
5. Acceptable use. You may use the Service only for sites you own or are authorised to manage. You must not point the Service at, or use it to crawl, any site other than the one it is installed on. You must not attempt to access another site's index or data, overload or probe the Service, bypass rate limits or plan limits, or use the Service to publish unlawful content. We may suspend the Service for a site that breaches this section.
6. Your content. You keep all rights in your site's content. You grant us a limited licence to fetch, store, process and display your site's public content only as needed to provide search on your site. This licence ends when your data is deleted under section 9.
7. Availability. We use reasonable efforts to keep the Service available and your index current. There is no service level agreement on the Free plan. Paid plans also carry no formal service level agreement, but we prioritise incidents that affect them. On the Business plan, priority support means Business support requests are answered before other requests, with a target of a reply within one business day. Planned maintenance is kept short and announced where practical. The Service depends on your site being reachable and its content being readable; we are not responsible for items we cannot fetch because of your site's settings, outages or blocking.
8. Data. How we handle data is described in our Privacy Policy. Where we process personal data on your behalf (visitor search queries), we act as your processor and process it only to provide the Service.
9. Termination and deletion. You may stop using the Service at any time by uninstalling it. When the app is uninstalled, we delete your site's indexed content, page records, search queries and settings within 24 hours. The app instance ID alone is kept for 30 days to absorb late notifications from the platform, then deleted. We may terminate or suspend the Service for a material breach of these Terms, with notice where practical.
10. Disclaimer. The Service is provided "as is" and "as available". To the extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
11. Limitation of liability. To the extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, including lost profits, lost revenue or loss of data. Our total liability for any claim under these Terms will not exceed the fees you paid for the Service in the three (3) months before the claim arose. Nothing in these Terms limits liability where applicable consumer law does not allow it.
12. Governing law and disputes. These Terms are governed by the laws of India, without regard to conflict-of-laws rules. Any dispute arising from these Terms or the Service is subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India, except where applicable local consumer law gives you the right to bring a claim in your own jurisdiction.
13. Changes. We may update these Terms. We will announce material changes in the dashboard at least 30 days before they take effect. Continuing to use the Service after that means you accept the revised Terms. If part of these Terms is unenforceable, the rest remains in effect.
14. Contact. Kamaldeep Singh, trading as MercAI, 1138, Bellandur, Bengaluru 560103, Karnataka, India. Support: devkamal01@outlook.com. Legal notices: hello@mercai.in.
